Les modalités plurielles de réception de la formation syndicale dans la pratique de la justice prud'homale : entre comportements individuels et action de groupe.
Cette contribution consistera à aborder la question de la formation syndicale dans une sphère originale de l'activité militante que constitue la justice prud'homale. En s'appuyant sur un certain nombre d'éléments recueillis au cours d'une enquête monographique menée dans une grande ville, et complétés par des entretiens effectués avec des formateurs des grandes confédérations, nous souhaitons traiter de la formation syndicale sous l'angle de sa réception au sein de la juridiction. Nous essaierons d'apprécier en quoi les pratiques des conseillers prud'hommes du collège salarié témoignent de la réutilisation d'éléments techniques, méthodologiques et théoriques acquis en formation, à différents niveaux. Mais nous verrons également que ce réinvestissement à une échelle locale n'est pas neutre et donne lieu à de nombreuses interprétations qui organisent les pratiques en fonction des différents groupes de socialisation auxquels appartiennent les conseillers (syndicat, collège, conseil, branche professionnelle...). Nous montrerons enfin que la complexité du réinvestissement de la formation ne s'apprécie pas seulement au niveau de la transmission individualisée du savoir-faire mais aussi à un niveau collectif (organisations, collèges...). Ainsi, la formation peut être un vecteur d'investissement par les organisations syndicales et patronales de stratégies d'évolution du droit du travail, de visions du monde et de conceptions de la justice prud'homale.
Various ways of recepting trade unions training within the prudhomme justice : from individual behaviours to collective action
This contribution consists in approaching the question of trade unionist training in the prud'homme justice, representing a specific sphere of militancy. On the basis of a monograph investigation realized in a big city and completed by some interviews with trainers of the most important trade unions, we wish to study the problem of the unionist training from the angle of its reception within the jurisdiction. We will try to evaluate how the practice of the councillors, representing the prud'homme employee body, reveals the reapplication of the technical, methodic, and theoretical elements acquired in the process of training, operated on different levels. We'll see as well that this reutilization is not neutral on a local level and gives rise to a diversity of interpretations organizing the practices according to different groupes of socialization to which a councillor belongs (trade union, representative body, jurisdiction, professional sector, etc.). At last, we'll show that the complexity of these usages can be evaluated not only on the level of the individual transmission of know-how but also on the collective level (trade union, representative body, etc.). Thus, the trade unionist training can be a vector, used by the trade union and the employers' group to diffuse their own strategies of evolution of the employment legislation, their world visions and their conceptions of the prud'homme justice.

Changer les valeurs sans en passer par les valeurs ? Les discriminations saisies par la formation syndicale à la CFDT
Cette communication porte sur les dispositifs pédagogiques de la CFDT concernant la lutte contre les discriminations et son appropriation en termes de " valeurs " et de pratiques syndicales par les militants. Entre 1997 sortie de Le racisme au travail et 2007, la CFDT est passée dun propos sur la lutte contre le racisme et contre le Front National à une lutte contre les discriminations et en faveur de légalité des chances. A travers un travail ethnographique portant sur la CFDT Nord-Pas-de-Calais, nous étudions la traduction de cette évolution dans les dispositifs pédagogiques, en abordant : 1) la place de lidéologie, ou comment les dispositifs visent à transmettre explicitement des " valeurs " de lorganisation : le contenu des dispositifs pédagogiques se caractérise par un affaiblissement de la transmission de ces " valeurs ", notamment au motif de ne pas juger le " rapport à létranger " des adhérents participant ; 2) la place respective de la parole profane et de la parole experte ; les dispositifs sollicitent de manière importante lexpression des participants, mais font également appel à lintervention " dexperts " sur un champ dépassant le juridique. La place de lune et de lautre varie selon " loutil " employé (dispositif de formation ou de sensibilisation) et leur coexistence renvoie à la fois à la genèse du dispositif (usage spécifique de la recherche-action par la CFDT, influence des modes de financement dorigine européenne notamment) et au contexte syndical interne (relégitimation du " terrain ") ; 3) linscription de ces caractéristiques dans une conception plus globale des dispositifs de formation, dont il sagira de vérifier si elle est impulsée au plan confédéral ou si elle est liée à une appropriation régionale rendant compte dune autonomisation des structures internes à la CFDT en matière de contenus de formation.
Changing values without talking values ? The question of discriminations in the educational devices of the CFDT
This presentation concerns the educational devices of the CFDT union against discriminations and their being embraced as "values" and union practises by the militants. Between 1997- date when "Racism at work" was published- and 2007, the CFDT moved on from its agenda against racism and the National Front to a stance against discriminations and in favour of equal opportunities. Through an ethnographic study on CFDT Nord Pas de Calais, we are analysing the impact of this evolution on its educational policies and are considering the following: 1) the place of ideology, i.e. how policies aim to explicitly transmit the "values" of the union : these policies have placed less emphasis on these values, in order not to judge the "perception of foreigners" of participating members. 2) The balance between the voice of members and the voice of experts : the educational devices encourage the expression of participating members but also call for the intervention of "experts" on issues going beyond legal matters. The place of both varies depending on the tools used (training or awareness campaigns) and their coexistence goes back to the origin of this campaign (specific use of research-based campaigns by the CFDT, influence of the modes of financing in particular from European funds) and to the context of the union itself (reappropriation of the "field"). 3) The transcription of these characteristics in a more global approach of training devices and whether it takes its source nationally or regionally which would take into account the autonomy of internal structures of the union in terms of training contents.

Une formation en formation : lenjeu de la " continuité syndicale " à lUnion Confédérale des Retraités (UCR)-CGT
Le vieillissement des effectifs dans les organisations syndicales françaises de salariés, depuis les années 80, a régulièrement été mis au compte des indices dune " crise du syndicalisme " marquée notamment par une " crise des vocations militantes ". Une des conséquences potentielle de ce vieillissement est cependant passée au second plan : lavènement dun syndicalisme retraité " actif ", pensé dans les termes de la " continuité syndicale ". Cette " continuité syndicale " simpose peu à peu comme un axe majeur de la politique de la CGT. Mais la place des retraités au sein de la CGT est encore incertaine. La " cause syndicale " des retraités est encore en construction et se heurte aux " catégories de lentendement syndical ". Les retraités, à limage des " privés demploi ", font en effet figure de catégorie " satellite " du salariat, définie négativement par rapport à celui-ci. De nombreux militants déplorent être cantonnés au statut de " force dappoint ". Face à cela un véritable travail de construction de sens est mis en uvre, tendant à légitimer le rôle des retraités syndiqués au sein comme en dehors de la confédération. A loccasion de journées détudes à différents niveaux de lorganisation est posée la question de la place du syndicalisme retraité. La formation à la " continuité syndicale " y est régulièrement présentée comme un moyen " délargir le rapport de force " dans la société, ainsi que de convaincre les adhérents actifs prochainement à la retraite de la nécessité de rester syndiqué. Mais les formes dune telle formation ne sont pas encore clairement définies au niveau confédéral. Les quelques stages existants tiennent à des initiatives localisées. Dès lors, avant de prendre une forme " durcie " dans des dispositifs formels, la formation à la " continuité syndicale ", aux enjeux revendicatifs correspondants, se fait dabord dans des conjonctures, certes encadrées, codifiées, voire ritualisées, telles que les congrès fédéraux ou confédéraux de retraités, mais " fluides " au regard des formes " classiques " que prennent les formations syndicales. Bien que ces moments ne sapparentent pas à proprement parler à des dispositifs de formation, sy jouent néanmoins une offre de " cadres cognitifs ", de répertoires de sens, des appropriations de savoirs, de ressources discursives.
A training in formation: the stake of "trade-union continuity" in the Confederal Union of Retired (UCR) - CGT.
The ageing of manpower in the French trade-union organizations, since the Eighties, has regurlarly been linked to the clues of a "crisis of the trade unionism" marked in particular by a "crisis of the militant vocations". One of the main consequences of this ageing was however secluded : the advent of an "active" retired trade unionism, thought in terms of "trade-union continuity". This "trade-union continuity" becomes assertive like a major axis of the policy of CGT. But the position of retired people within CGT is still unsure. The "cause" of the pensioners is still being built and runs up against the "categories of the trade-union understanding". The pensioners, like the jobless, have indeed the appearance of a "satellite" category of wage-earning, negatively compared to the latter. Many militants deplore being positioned as "auxiliary force". In front of this, a true building work of ways is implemented, in order to legitimate the part of retired trade unionist inside or outside the confederation. Surveys have been held at various levels of the organization in order to find out the place of retired trade unionism. Training towards "trade-union continuity" is regularly introduced like a means "of widening the ratio of force" in society, as well as to convince the "next to retire" members of the need to remain in the trade union. But the ways of a training as such are not yet clearly defined at the confederal level. The few existing training courses belong to local initiatives. Consequently, before hardening inside formal devices, training with "trade-union continuity", with the corresponding claiming stakes, is done initially through economic situations, certainly framed, codified, even ritualized, such as the federal or confederal congress, but "flowing" compared to the "traditional" form which take the trade-union trainings. Although these ways are not connected specifically with devices of training, there is nevertheless an offer of "cognitive frameworks", repertories of meanings, appropriations of knowledge, discursive resources.

La formation syndicale à Sud-PTT : enjeux et modalités de la formation dans une organisation syndicale récemment créée
Dès sa fondation en 1989, la fédération Sud-PTT met en avant une conception de la formation syndicale comme indispensable outil dédification dun syndicalisme " nouveau ", où les syndicats locaux ont une grande autonomie et où chaque adhérent est invité à participer effectivement aux prises de décision. On retracera les principaux linéaments et difficultés de la mise en place de la politique de formation interne à Sud-PTT. Par ailleurs, on présentera les principaux résultats dune enquête ethnographique menée auprès de deux syndicats Sud. On analysera ainsi les répercussions du manque de formation sur la socialisation intra-organisationnelle : il apparaît notamment que des injonctions implicites et parfois explicites dautoformation pèsent sur les militants, et, dans certaines configurations, se traduisent par un processus de différenciation entre militants expérimentés et néo-militants. Parallèlement, on distinguera des configurations où les pratiques dautoformation sapparentent à un apprentissage assez " scolaire " et ascétique et celles où elles tiennent davantage dun bricolage empirique éloigné des pratiques scolaires. On sattachera aussi à examiner le hiatus existant entre deux conceptions de la formation : pour certains (et notamment les " militants historiques " de Sud), la formation est un indispensable vecteur de démocratisation du syndicat ; alors que dautres (notamment parmi les néo-militants) voient dans la relative pénurie de formations une traduction du fait que Sud serait un syndicat moins pyramidal que les autres, où les militant-e-s ne sont pas " formaté-e-s ". Enfin, on présentera les résultats de lobservation de plusieurs formations de délégués du personnel de France Télécom, et entre autres les logiques selon lesquelles les formateurs " jouent " avec les cahiers de formation élaborés par la Fédération, ainsi que la manière dont ils incarnent très consciemment mais sans lexpliciter un " style Sud " dans leurs pratiques pédagogiques.
The educational policy of SUD-PTT : issues and methods of training in a newborn union
From its foundation in 1989, the amalgamated trade-union SUD-PTT advances a conception of the trade-union training as an indispensable tool of construction of a "new" type of trade unionism, in which the local trade-unions have a large self-governance and where every member is invited to participate in decision-making. A first point will be made on redrawing the main lineaments of the messy first advancements in the internal training policies of SUD-PTT, and the obstacles which made it difficult. Besides, the main results of an ethnographical survey made in two trade-unions SUD will be presented. Thus the repercussions of the lack of training on the intra-organizational socialization will be analysed: it largely seems that certain implicit orders - and sometimes explicit - of self-training press on the militants, and are sometimes translated by a process of differentiation between experimented militants and the new ones. Secondly, the practices of self-training, according to the situations and the resources of the concerned militants will be shown as more or less similar, according to the cases, to a form of rather schoolmasterish and ascetic learning or to a kind of do-it-yourself remote from school practices. Besides, an examination of a hiatus existing between two conceptions of the training will be made: For some (in particular the " historic militants "), the internal training is an indispensable vector of democratization of the trade-union; while others (notably among the militants recruited quite recently) see in the relative shortage of training courses a consecration of the fact that SUD would be a trade-union less pyramidal than the others, where militants are not "formatted". Finally, the results of observations of several staff representatives' training courses of France Telecom will be presented, and among other the way in which the trainers embody very consciously but without being explicit in it a " style the SUD " in their teaching practices.

Les usages pluriels dune formation " subie ". Lexpérience de militants de KESK dans une formation animée par la CES
Notre communication porte sur lappropriation et les usages par des syndicalistes de KESK, une confédération turque fortement marquée à gauche et en butte à lhostilité institutionnelle, dune formation prodiguée par la CES à ses quatre membres turcs (dont KESK fait partie) à Istanbul en 2001-2002. Les relations entre KESK et la CES sont marquées par la dépendance de la confédération turque à la protection prodiguée par la centrale européenne face aux menaces étatiques. La formation est donc une proposition que KESK ne peut refuser. Cette formation est ainsi " subie " par les membres de KESK dont la situation va être paradoxale puisque, dune part, les valeurs de " dialogue social " qui y sont défendues sont contraires aux mots dordre fondateurs de leur confédération, et dautre part, les pratiques qui y sont exposées ne correspondent pas à leurs activités quotidiennes étant donné que la confédération est arbitrairement exclue des principaux organismes de négociation institutionnalisée. La formation intervient à une période durant laquelle la confédération turque connaît une plus forte intégration dans le syndicalisme européen, ce qui rend désormais impossible la gestion par le non dit des différences qui étaient en vigueur jusque-là, et est en pleine évolution vers un alignement sur les positions de la CES. Il sagit pour KESK de continuer à avoir un discours contestataire tout en changeant le fondement de la contestation pour être conforme aux normes de la CES. La direction de KESK assigne à cette formation lobjectif de mettre en lumière les différences entre le fonctionnement du "dialogue social" en Europe et en Turquie et ainsi fournir les bases argumentatives dun positionnement critique mais néanmoins sur la ligne de la CES. Pour ces dirigeants la formation ne vise pas à doter les syndicalistes dune plus grande compétence dans leurs pratiques mais avant tout de donner à la réorientation de la confédération une certaine consistance argumentative et en " interne " à participer à la redéfinition, jamais formalisée, des enjeux des luttes syndicales.
The plural uses of an "imposed" training. KESK militants experience in a training managed by the ETUC
Our presentation deals with KESK trade-unionists appropriation and uses of a training provided by the ETUC to four of its Turkish members (KESK being one of them) in Istanbul in 2001-2002. KESK, a left-wing Turkish confederation which had always come up against strong institutional opposition, depended heavily on the ETUCs protection from a range of menaces from the State. In this context, KESK was not in a position to turn down the training. This training was therefore "imposed" on KESK members, whose situation was paradoxical in that, on the one hand, the notion of "social dialogue" endorsed by that training were antithetical to the founding precepts of their confederation and on the other hand, the outlined practices did not correspond to their daily activities, as the confederation had arbitrarily been excluded from the main bodies of institutionalised negotiation. The training took place at a time when the Turkish confederation was experiencing a stronger integration into European trade-unionism, which made it impossible to deal with differences by simply ignoring them as it had been the case so far; KESK was also gradually adopting the ETUCs positions. The point was for KESK to remain a voice of dissent while changing the grounds of dissent to comply with the ETUCs standards. The head of KESK assigned to this training the aim of highlighting the differences in the way the "social dialogue" was implemented in Turkey and in Europe so as to provide the argumentative foundations of a critical position while remaining in compliance with the ETUC. For these leaders, the aim of the training was not to confer trade-unionists with a greater competence in their practices but primarily to give the reorientation of the confederation some argumentative consistency and, internally, to take part in the redefinition which had never been formalised of the issues and objectives of trade union struggle.

Georges Friedmann, mars 2007), qua été abordée lanalyse
des formations " de premier niveau " dans cette organisation.
Ces formations sinscrivent dans un cadre national, mais nexistent
quau niveau des Unions locales. Leur étude permet donc danalyser
le travail de diffusion de représentations du monde social et de définition
du " syndicalisme CGT ", à travers les supports élaborés
par le secteur confédéral de la Formation syndicale, mais aussi
les usages locaux qui en sont faits, face à des groupes de stagiaires
aux trajectoires sociales, professionnelles et militantes très diverses.
Cette communication
se base sur une enquête de terrain (réalisée par Y. Siblot,
avec M. Bensoussan), menée doctobre 2004 à janvier 2006
en région parisienne. Des observations ont été réalisées
durant 3 stages, un ensemble de documents a été consulté,
et des entretiens ont été réalisés avec des stagiaires,
responsables de la formation et formateurs. On évoquera dabord
la façon dont les formations sont montées au niveau de lUnion
locale. Les contraintes dorganisation font que les formations sont issues
dun bricolage entre le cadrage national et les ressources locales disponibles,
et elles rendent difficile une maîtrise du contenu des stages, ou de la
sélection des stagiaires. Nous montrerons alors que les stages constituent
des périodes de sociabilité intense, où les " à
côtés " de la formation contribuent aussi fortement que
les contenus eux-mêmes, parfois perçus comme abstraits, à
la transmission ou à la réaffirmation dun certain nombre
de valeurs et de normes militantes au sein de groupes de stagiaires hétérogènes.
First Level training sessions in the French union CGT. Local uses of a national frame of socialization
The study of the training of trade unionists has been conducted during a larger research concerning the recruitment of new members in the CGT. The " Fist Level " training sessions are designed at a national level, by a specific department in the CGT, but there are organized at a local level in every town or neighbourhood, by the " Unions locales " (local trade unions). Studying those " first level " sessions helps to understand how values and representations are determined at a national level, through text books and courses programs, and it allows also to see how there are locally translated and adapted, in front of trade unionists whose trajectories are very diverse. This research is based on a fieldwork conducted between 2004 and 2006 close to Paris. We did participant observation during three training sessions, we also collected documents, and made interviews with trade unionists (both instructors and trainees). This presentation will describe in the first place how the training sessions are organised locally : the poor human and financial resources lead to the adaptation of the national frame, depending on how is available to organise the session and what instructors can teach, and also on who the trainees are. Secondly, we will show that those one-week long trainings are intense periods of sociability. This sociability is as important as the content of the lectures in the transmission of values and norm inside the groups, especially because of the political and social diversity of the trade unionists.
